Description:

This course will consider how growing concerns about privacy and national security will affect traditional First Amendment legal theory and practice. We will examine significant court decisions and statutory and regulatory schemes, such as the PATRIOT Act, as well as international initiatives, such as the European Directive on Data Protection and "The Right to be Forgotten." We will consider their impact on U.S. law governing prior restraints, news gathering and dissemination, access to courts and to government information, as well as government surveillance and regulation of electronic communications. In addition to participating in class discussions, students will write and orally present a research paper on a relevant legal topic selected in consultation with the instructor.
