Description:

This seminar will examine theories, structures and concepts typically found in constitutions around the world, including judicial review, separation of powers, federalism, and rights. We will consider why comparison is an important legal concept, we will examine different methods of constitutional interpretation, and we will explore written vs unwritten constitutionalism, etc. The course will primarily focus on US and Canadian comparisons, though constitutions from many other countries will also be considered. Students will select a topic related to comparative constitutional law and explore it in depth through writing a seminar paper.Grades will be based on a final paper (80%) and class participation/presentation (20%).
