3Ls Ben Tozer and Bobby Mir Win ABA National Negotiation Competition
FEBRUARY 9, 2012—The ABA National Negotiation Competition is the culmination of many local and ten regional tournaments. On Feb. 2, 2012, the Law School’s competitors and alternates for the competition traveled to the ABA mid-winter meeting in New Orleans to vie with 228 teams representing 116 law schools. Ben Tozer (’12) and Bobby Mir (’12) emerged as the 2011-12 ABA Negotiation champions.
The problem-solving, interest-based negotiation centered around four issues this year. In the first round, the team represented a fictional Christian college attempting to buy a house from a reluctant seller. In the second round, they represented the client in negotiations with a local regulatory entity for a zoning variance against serious objections from neighborhood residents. Tozer and Mir, who were first-place winners in the regional competition in Kansas City last November, placed first among 24 teams in rounds one and two.
In round three, the semifinal round, Tozer and Mir represented the college again, this time in its attempt to save a "megachurch" from bankruptcy. Their win advanced them to the final round, where they successfully represented the college’s unhappy dean, seeking a rescission of the sale of a house believed to be a "stigmatized," ghost-infested property.
The alternate team of Jade Holman (’13) and David Morine (’12), ranked first going into the final round at the regional competition in November, were tireless sparring partners late into the night before the New Orleans semifinal and final rounds. Their help in preparing for the strenuous national competition was invaluable.
Law School teams, coached by Professor Mary Alton, have participated in the ABA Negotiation Competition since 2005. Four teams have gone to the final regional round and two teams have gone on to nationals.
Tozer and Mir's national win sends them to the 2012 International Negotiation Competition at Queen's University in Belfast, Northern Ireland in July 2012.
