Kirtley comments on Washington Times subpoena

Prof. Jane Kirtley was quoted in the New York Sun in a story concering the subpoena of Washington Times reporter William Gertz, who has been asked to identify sources for a news story he wrote about the prosecution of a Chinese spy ring based in southern California. Kirtley noted that the 9th Circuit U.S. Court of Appeals has not been receptive to journalists claiming a constitutional privilege in recent cases, and predicted "If Gertz is ordered to testify, he resists, and is held in contempt, then it's a repeat of the same scenario we've been dealing with."
